Action Bar different across sections

I'm not sure if this is a bug or if I'm doing something wrong (most likely the latter)

But I have the entry relationship field across a couple of different sections. Each section is linking to the same sections e.g. page text, page images.

On the first section I did this on I have buttons to select which entry relationship to add e.g. page text. However on subsequent sections I get a drop down box to select the relationship to add.

I am using a custom template for the action bar but all of the sections have been set up in exactly the same way, so I can't work out why the html structure of the action bar is different on the first compared to all of the others.

Any help would be greatly appreciated.
