Explanation of the issue:
When a game is launched from a game cart (in this case, Mario Kart 7), and the screen is closed, if the cart is bumped out of the slot and re-inserted, the device will hang on a black screen. It responds to the power button to power off.
Steps to reproduce:
Insert game cartridge and launch
Close 3DS lid
Remove game cart and re-insert
Open lid to black screens
Fix: power off device and power on as usual
Note: it seemed as though at least once it reached the condition of "bootable to luma config menu, won't reach home menu, dual black screens, if left alone for a while it will boot into the home menu without difficulty" but I am as of yet unable to reproduce the issue
