The app is not kept in the overview (recent apps) if the app icon is not "Futuristic".

Yes on Android 12 once, but on Android 9 always.

I tried the app on different versions in the emulator. It was always showing for me, but only the name and the icon are not showing in recent menu.

If you mean that the app stays running in the background and when you click on the app icon it displays the last screen you left, yes that's what happens to me as well.
