I have a fix and I have a solution but the problem is that my IT fails. I did not have time to debug it. I can create a PR on GH and you guys may help me with investigating it and debugging.

I've started work on junit-team/junit-framework#1880 and also started a branch to integrate it into Surefire (see marcphilipp#1). I'll submit a PR to this repo when JUnit 6.0.0-M2 is available.
