Overview

We need to include neighborhood council legal requirements in the future modeling process.

Action Items

  • Research the scope of neighborhood council legal requirements (quantify).
  • Create list of questions for Empower LA
  • Confirm questions are not already answered on website
  • Assemble a list of questions for LA City Attorney's Office from notes.
  • If they are, add them to the wiki

We will take a two-phase approach and speak with neighborhood councils for understanding of legal process.

Put together an agenda for Empower LA with all the questions we want to ask them (including but not limited to):

  • how does the brown act affect agenda creation from the council perspectives
  • what role does the liaison from DONE (dept of neighborhood empowerment) have with responsibility for the agenda
  • storage requirements - do we have to save for a certain amount of time (minimum requirements)
  • does DONE want copies of what goes to the councils
  • does DONE want stats on any part of the process - if so what?
    • how many are posted per council?
    • how many agendas vs neighborhood meetings?
    • how long does an agenda take to create?
    • how many people touch the agenda?
    • comment data? when do people post the comments?
    • when do the councils post the agendas in advance of the meeting?

Progress: Added more links to the initial issue that contains insightful information regarding the impact of the Brown Act and agenda process.
Blocks: Legal requirements are embedded within webpages regarding impact to meetings. It may take some time to find all of the information we need (quantity).

Progress: Created document to compile information regarding legal requirements. Added link to main issue comments. Located pdf training documents for review.

Eli and I met regarding comments on If/Then document. The document is updated, and we are clear about document content.
Blocks: Decision on what direction team will go on MVP. The decision will affect legal requirements.

Questions that we have for Legal at empower
Q: Should comments on the website stay open to the end of public comment time at regular meetings?
A: In the meeting: The comments are only appropriate during the time the chair says the item is open for public comment

Q: What part of the agenda are members allowed to discuss between meetings? None, but they can have a process to add items to the agenda (a folder, form, recommendations from committees, etc.) then the president or executive committee, will produce the agenda. Some NCs publish how they do the agenda setting so that people can ask for things to be added.

Q: What happens to agenda items that need to be changed last minute? For example, a presenter is unavailable or cancels close to meeting time.
A: If the cancelation happens within 72 hour before the meeting, then it stays on the agenda and the motion is tabled until next meeting. If the cancelation happens before the 72 hour window, then they can republish the agenda.
