Intel's backport drivers also compile mac80211.ko and cfg80211.ko. If they are part of the vmlinux, this causes symbol re-export and causes bakcported dkms module not to compile, even it is compiled with some hacking, they wont run during execution due to security measures against symbol overriding.

When cfg80211 and mac80211 are built as modules, further dkms modules can override them without issues.
